This website and any of our services (the “Site”) are to provide you with information, services and facilities about Club Soda Drinks and its related projects and initiatives. By accessing any of the information on the Site and/or using any of the services available on the Site you agree to comply with the Terms and Conditions set out below, or as otherwise amended at the time of your visit to and/or use of the Site. If you do not agree with these Terms and Conditions please do not make any further use of the Site.
General terms and conditions
1. Definitions
“Club Soda Drinks” means Club Soda Drinks Limited, a company registered in England with number 16011569, having a registered office at 30 Opus Studios, 214 Plaistow Road, London E13 0AQ, United Kingdom. References to “we”, “us” and “our” should be construed as references to Club Soda Drinks Limited.
“Content” has the meaning given in clause 3.1 below.
“Site” has the meaning given in the Introduction above, and includes but is not limited to digital content at clubsodadrinks.co.uk, its subdomains, mobile applications and any online platforms on which we operate.
2. Applicable terms and conditions
The Site is owned and operated by Club Soda Drinks and any use made of the Site are subject to these Terms and Conditions.
Club Soda Drinks may, at its sole discretion, modify or revise these Terms and Conditions at any time by updating the text of this page.
You may use the Site in accordance with these Terms and Conditions. These Terms and Conditions form the legal basis of your use of the Site.
2.1 Unacceptable use
You agree not to use the Site or any part of it:
(a) to post, upload, or otherwise transmit any material which infringes the rights of any person or which is unlawful in any way;
(b) in any manner which could damage, disable, overburden, or impair the Site;
(c) to make available personal data about any person other than yourself, or to collect or store personal data about other users;
(d) to obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site;
(e) to impersonate any other person or to provide false or inaccurate information;
(f) to promote any discrimination based on race, ethnic origin, nationality, sex, gender, religion, disability, sexual orientation or age, or act in any way which is threatening, harmful, abusive, defamatory, sexually orientated, hateful, invasive of another’s privacy or obscene, or which will (or potentially will) harass, distress, embarrass or inconvenience or be objectionable by any person or which might restrict or inhibit the use and enjoyment of the Site by any person;
(g) to post, upload, or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation or commercial exploitation;
(h) to post, upload, or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, restrict, destroy, limit the functionality of or compromise the integrity of any computer software or hardware or telecommunications equipment;
(i) to create a database (electronic or otherwise) that includes Content;
(j) to transmit or re-circulate any Content to any third party; or
(k) to bring (or act in any way that might bring) Club Soda Drinks into disrepute.
2.2 Breaches of acceptable use
When issues are brought to our attention we will determine whether there has been a breach of these Terms and Conditions. When we decide that such a breach has occurred, we may take any action we deem appropriate, including, but not limited to removing any posting or material you have uploaded to the Site; withdrawing your right to use the Site; taking legal action against you; or disclosing such information to law enforcement authorities as we reasonably feel is necessary.
2.3 Commercial and illegal use
You shall not use the Site to promote, advertise or otherwise encourage the acquisition or purchase of goods and/or services unless permitted to do so with the express written permission by Club Soda Drinks.
You agree not to distribute illegal materials of any kind. This includes images, text or graphics.
3. Copyright and other rights
3.1 All copyright and all other intellectual property rights in all information, text, data, graphics, links, computer code, images, sound, software, service marks, logos and other materials on the Site (the “Content“) are owned by Club Soda Drinks, or are reproduced on the Site with permission of the relevant rights owner.
3.2 The Content may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without Club Soda Drinks’s prior written consent, except as stated in the paragraph below.
3.3 You may read, view, print, download and (where appropriate) listen to the Content of an individual page for private and personal non-commercial use only provided that all copyright, trade mark and other proprietary notices contained in the original Content on any copy of such Content is retained, but you may not make more than one (1) copy electronically or otherwise of any of the Content and you may not re-copy or further distribute, sell, publish or transmit any part of the Content by electronic or any other means.
3.4 You agree not to sell, resell, supply or otherwise make the Content or extracts or other information derived therefrom available in any manner or on any media to any third party without the express prior written consent of Club Soda Drinks.
3.5 The names, images and logos identifying Club Soda Drinks, its projects, products and services, or those of third parties, are the proprietary marks of Club Soda Drinks, and/or may be the proprietary marks of third parties. Any use made of these marks may be an infringement of rights in those marks and Club Soda Drinks reserves all rights to enforce such rights that it might have.
4. Purchases
You can cancel an order up to 14 days after receiving goods from us. If your order has been dispatched, you will be responsible for paying for your own shipping costs to return items to us. Shipping costs are non-refundable.
To be eligible for a refund, any items you return must be unopened, in the same condition that you received them, and in the original packaging. Returns should be sent to Club Soda Tasting Room, 39 Drury Lane, London WC2B 2RR.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
5. Privacy
5.1 Any information that you provide about yourself to Club Soda Drinks will only be used by us in accordance with our Privacy Policy. By using the Site you consent to our use of data collected on this Site in the manner set out in the Privacy Policy.

6. Changes to these terms, and amendments to the content
Club Soda Drinks reserves the right, at its discretion, to make changes at any time to any part of the Site and any other services it offers. Due to our updating and improving the Site, Club Soda Drinks may wish to change these Terms & Conditions from time to time and you agree to be bound by the Terms & Conditions which apply at the time of your use of the Site and any other Club Soda Drinks services.
7. General notes
7.1 These Terms & Conditions shall be governed by, and construed in accordance with, English law and you and Club Soda Drinks agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with the same or the legal relationship established by them or any use of the Site or related products and services and including the construction of this relationship.
7.2 If any provision of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms & Conditions, which shall remain in full force and effect.
7.3 Failure by either party to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.
7.4 Headings in these terms are for convenience only and will have no legal meaning or effect.
7.5 If we fail, at any time during the term of your use of the Site, to insist upon strict performance of any of your obligations under these terms of use, or if we fail to exercise any of the rights or remedies to which we are entitled under these terms of use, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with the methods specified below.
7.6 When using the Site, you accept that communication with us will be mainly in electronic format. We will contact you by email or provide you with information by posting notices on our site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
